1. Agreement to These Terms

These Terms of Service (“Terms”) govern your use of the websites, applications, and services provided by Be Your Own Best Coach, doing business as Stamina Lab (“Stamina Lab,” “we,” “us”), including SolutionCoach AI™, our AI-powered coaching practice tool, and related training services (together, the “Services”). By creating an account, signing in, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

2. What SolutionCoach AI Is — and Is Not

SolutionCoach AI is an educational practice tool that simulates a coaching client so students in Stamina Lab programs, including the Foundations in Solution-Focused Health Coaching Certification, can practice solution-focused coaching skills in a low-stakes environment.

The Services are for education and training only. The simulated client is artificial intelligence, not a real person. Feedback, labels, and evaluations generated by the Services (such as question classifications) are automated educational signals, not professional assessments of your competence and not a substitute for instructor evaluation. The Services do not provide medical, psychological, clinical, or therapeutic advice, and nothing in the Services creates a coach-client, provider-patient, or therapist-client relationship.

3. AI-Generated Content

Responses and evaluations in the Services are generated by artificial intelligence, including third-party AI providers that process your inputs on our behalf. AI-generated content can be inaccurate, incomplete, or inconsistent. You are responsible for exercising your own judgment about how to use it in your learning.

4. Accounts and Eligibility

You must be at least 18 years old to use the Services. You agree to provide accurate account information, keep your login credentials confidential, and notify us promptly of any unauthorized use of your account. You are responsible for activity that occurs under your account.

5. Acceptable Use

You agree not to: (a) use the Services for any unlawful purpose; (b) attempt to bypass usage limits, rate limits, authentication, or other technical protections; (c) probe, scrape, copy, decompile, or reverse-engineer the Services or their underlying prompts, frameworks, or content; (d) submit content that is abusive, harassing, or infringes the rights of others; (e) use the Services to build a competing product; or (f) share your account or resell access to the Services.

6. Usage Limits

To keep the Services available and affordable for all students, we may apply usage limits (such as daily question caps and demo limits) and may change them at any time. We may suspend or restrict accounts that exceed limits or violate these Terms.

7. Intellectual Property

The Services — including the software, the Dialogic Orientation Quadrant (DOQ)-based training content, prompts, evaluation criteria, trademarks (including “SolutionCoach AI” and “Stamina Lab”), and all related materials — are owned by Stamina Lab or its licensors and are protected by intellectual-property laws. Your enrollment or account grants you a personal, non-exclusive, non-transferable license to use the Services for your own learning, and no other rights.

You retain ownership of the text you submit. You grant us a license to process, store, and analyze your submissions and session transcripts to operate and improve the Services and to support your training (for example, instructor review of practice sessions).

In addition, you agree that we may use practice-session content in de-identified or aggregated form — with names, email addresses, and other directly identifying details removed — for research, curriculum development, quality evaluation, and the development, training, and improvement of educational AI models and tools. We will not sell your personal information, and de-identified data will not be used to re-identify you.

8. Privacy

Our collection and use of personal information — including account details, session transcripts, usage data, and IP addresses — is described in our Privacy Policy. By using the Services you consent to that collection and use.

9. Availability and Changes

We may modify, suspend, or discontinue any part of the Services at any time. We aim for high availability but do not guarantee the Services will be uninterrupted or error-free.

10. Termination

You may stop using the Services at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if your program enrollment ends. Sections 7, 11, 12, and 13 survive termination.

11. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THE ACCURACY OF AI-GENERATED CONTENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STAMINA LAB WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE OR (B) ONE HUNDRED U.S. DOLLARS ($100).

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in the State of Florida, and you consent to their jurisdiction.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you (for example, by email or an in-app notice). Continued use of the Services after changes take effect constitutes acceptance.
